Terms of service.

The agreement between you and NewLevel for using this website. It is short, it is in plain English, and the parts that matter most — what we promise, what we do not, and how our text messages work — are all here.

1. Accepting these terms

These Terms of Service are an agreement between you and New Level Investment RE Corp (Florida real estate license CQ1068723) ("NewLevel", "we", "us"). By visiting https://newlevelinvestment.com, submitting one of our forms, or messaging us through the site, you agree to them. If you do not agree, please do not use the site.

You must be at least 18 years old and able to enter a binding contract to use this site or submit a form on it.

These terms cover the website only. If we go on to work together, the listing agreement, buyer representation agreement, purchase contract or construction agreement you sign governs that work, and it controls over anything written here.

2. Who we are

New Level Investment RE Corp (Florida real estate license CQ1068723) is a real estate brokerage operating in the State of Florida, serving Miami-Dade · Broward. We help people sell and buy homes, buy at the county foreclosure auctions, and plan custom builds.

We are an Equal Housing Opportunity business. We do not discriminate on the basis of race, colour, religion, sex, disability, familial status, national origin, or any other class protected by federal, Florida or local fair housing law.

3. The site is information, not advice

Everything on this site is general information about real estate in South Florida. It is not legal advice, not financial or investment advice, not tax advice, not accounting advice and not an appraisal.

Real estate, foreclosure and construction decisions turn on facts we do not know about you. Before you act on anything here, talk to your own attorney, accountant, tax advisor, lender or licensed inspector. Nothing on this site creates a professional relationship with you in any of those fields, and we do not practise any of them.

4. Estimates, calculators and figures

The site includes illustrative calculators — a seller net estimate, a monthly payment estimate and an auction maximum-bid estimate — along with market figures, valuation ranges and example numbers. All of them are for illustration only.

They are rough models built from assumptions you can change on screen. They do not account for your actual credit, the actual condition of a property, actual title or lien status, actual taxes and assessments, insurance quotes, HOA or condominium fees, special assessments, or anything a lender or a title company will find. Real numbers will differ, sometimes by a lot.

Specifically, about the payment estimate:

  • It is an estimate, not an offer of credit, a loan commitment, a pre-approval or a quote.
  • It uses an interest rate you choose on screen. It does not calculate or display an Annual Percentage Rate, and it deliberately does not include every cost a lender must include in one.
  • It is not a Truth in Lending Act disclosure, a Loan Estimate or a Closing Disclosure, and it must not be compared against one.
  • We are not a mortgage lender or broker and we do not arrange credit. Only a licensed lender can tell you what you can actually borrow and on what terms.

Valuations we discuss with you are our professional opinion of value based on comparable sales and condition. They are not a licensed appraisal, and no lender will accept them as one.

5. No guarantee of price, sale, or auction outcome

We do not guarantee that your property will sell, that it will sell within any timeframe, or that it will sell for any particular price. We do not guarantee that you will win a property at auction, that a bid ceiling we work out together will be enough, or that a property you buy at auction will be free of liens, occupants, code violations or damage you have not seen.

We do not guarantee any return, profit, appreciation, rent, or investment result. Past results — ours or anyone else's — do not predict future ones. Real estate can lose value.

Foreclosure auction purchases are sold as-is, without inspection, and the risk of what you find afterwards is yours. Any help we give you in assessing one is an opinion offered in good faith, not a warranty of the property or of the title.

6. Using the site creates no agency relationship

Browsing this site, submitting a form, receiving a valuation, or exchanging messages with us does not make us your agent, your broker or your fiduciary, and does not create a brokerage relationship of any kind under Chapter 475 of the Florida Statutes.

A brokerage relationship begins only when we both sign a written agreement that says so, and only on the terms in it. Until then we owe you honesty and fair dealing, and nothing more. Information you send us before that point is not protected by the confidentiality a signed brokerage relationship carries, though we still handle it under our Privacy Policy.

7. SMS and text messaging

NewLevel runs a customer care and conversational text messaging programme. Its purpose is to reply to the request you made on this site and to move your enquiry forward: confirming details about your property, sending valuation and property information you asked for, scheduling calls, showings and walkthroughs, and answering your questions.

You join by ticking the consent box on one of our forms and giving us your mobile number. The wording you agree to, version 2026-09-20, is: "I agree that New Level Investment RE Corp may contact me by phone, text or email about my request, including by automated means. Consent is not a condition of any purchase. Message and data rates may apply; reply STOP to opt out."

The terms of the programme:

  • Consent to receive text messages is not a condition of any purchase, of any sale, or of receiving any service from us. You can ask us to use only email or only the phone instead, and we will.
  • Message frequency varies. Messages are sent in response to your enquiry and to the conversation that follows it, so how many you get depends on how much back-and-forth your request needs.
  • Message and data rates may apply. Your mobile carrier's plan governs what your messages cost you; we do not charge you for them.
  • Reply HELP to any message for help, and we will reply with support information and how to reach a person.
  • Reply STOP to any message to opt out. We will send one confirmation that you have been unsubscribed, and then stop texting that number. You can also ask us to stop by any of the contact routes in section 19.
  • Opting out of texts does not opt you out of email or phone calls, and it does not cancel any agreement between us. Tell us if you want those stopped too.
  • Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed, and it depends on your carrier, your device and your coverage.
  • This programme is for mobile numbers in the United States. Do not send us information you need kept confidential by text — text messages are not a secure channel.

How we store your number and your proof of consent is described in our Privacy Policy. We do not sell or share your mobile number, and we do not pass it to third parties for their own marketing.

8. Property information and listings

Property information on this site — including any listings, photographs, square footage, lot size, taxes, status and price — is gathered from sources we believe to be reliable but is not guaranteed. It can be out of date, incomplete or wrong, and a property can be under contract or sold before the page updates.

Sample listings shown while our MLS feed is being connected are for demonstration and do not represent properties that are for sale. Once the feed is live, listing data will be provided by the participating MLS, deemed reliable but not guaranteed, and displayed under that MLS's IDX rules, which take precedence over this section.

Verify anything you intend to rely on — with the county property appraiser, the clerk of court, a title company, a licensed inspector and your own advisors — before you make an offer or place a bid.

9. Acceptable use

When you use this site, you agree not to:

  • Submit false, misleading or stolen information, or someone else's contact details or phone number without their permission.
  • Scrape, crawl, harvest or copy the site's content or property data by automated means, or attempt to get around our rate limits or anti-spam measures.
  • Interfere with the site, probe it for vulnerabilities, or try to access any system, account or data you are not authorised to reach.
  • Use the site or our messages to send spam, to advertise, or for anything unlawful, harassing, defamatory, discriminatory or fraudulent.
  • Reproduce, republish or resell any part of the site for a competing service.

We can refuse service, block access or remove content at our discretion, particularly where a submission looks automated or abusive.

10. Intellectual property

The site and everything in it — the NEWLEVEL name, the monogram and wordmark, the design, the photography, the copy, the calculators and the code — belongs to New Level Investment RE Corp or to the people who licensed it to us, and is protected by copyright, trademark and other laws.

You may view the site, print pages for your own use, and share links to it. You may not copy, adapt, publish, sell or otherwise exploit any of it without our written permission. Content owned by others — MLS listing data, third-party photography, provider logos — remains theirs.

If you send us a suggestion or an idea about the site, you agree we may use it without owing you anything for it.

12. Privacy

Our Privacy Policy explains what this site collects, where it is stored, who it is shared with and how to have it deleted. It forms part of these terms, and by using the site you agree to it.

13. Disclaimer of warranties

The site and everything on it is provided "as is" and "as available", with all faults. To the fullest extent the law allows, we disclaim every warranty, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy and non-infringement.

We do not warrant that the site will be uninterrupted, secure, error-free or free of harmful components, that any content on it is accurate or current, or that any result you want will be achieved by using it. Some states do not allow certain disclaimers, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, neither NewLevel nor its owners, employees, agents or providers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost data or loss of goodwill, arising out of your use of this site or your reliance on anything in it — even if we were told such damages were possible.

Our total liability for any claim connected to this website is limited to one hundred US dollars (US$100), or the amount you paid us for access to the site, whichever is greater. This limit does not apply to liability that cannot be limited by law, including for fraud, wilful misconduct, or personal injury caused by our negligence, and it does not limit obligations under a separate signed agreement between us.

Some states do not allow these limits, so parts of this section may not apply to you.

15. Indemnity

You agree to defend, indemnify and hold harmless NewLevel, its owners, employees and agents from any claim, loss, liability, damage, cost or expense — including reasonable legal fees — arising out of your use of the site, your breach of these terms, your violation of any law, or your infringement of anyone's rights. We may take over the defence of any such claim at our own expense, and you agree to co-operate with us if we do.

16. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of these terms or your use of this site must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida. You and NewLevel each consent to the personal jurisdiction of those courts and waive any objection that the venue is inconvenient.

Any claim you have relating to this site must be brought within one year after it arises, or it is permanently barred, to the extent that limit is enforceable where you live.

17. Changes to these terms

We may update these terms. When we do, we change the effective date at the top of this page and publish the new version here. Continuing to use the site after a change means you accept it. If you do not accept a change, stop using the site.

We may also change, suspend or discontinue any part of the site at any time, without notice.

18. Severability and the rest

  • If any part of these terms is held unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in force.
  • Our not enforcing a provision is not a waiver of it.
  • These terms, together with our Privacy Policy and our Accessibility Statement, are the entire agreement between you and us about this website.
  • You may not assign these terms. We may assign them to a successor in connection with a merger or sale of our business.
  • Nothing in these terms makes either of us the other's partner, employee or joint venturer, and no one other than you and us has any right to enforce them.
